Prenuptial Agreement

A prenuptial agreement is like life insurance for your marriage.  You hope you never need it, but when you do, you will be glad you have it.  

A prenuptial agreement is a contract entered into by two people before their marriage to define their assets, rights, and obligations between one another in the event of a divorce.  Typically, a prenuptial agreement will govern issues of maintenance/spousal support, asset division, and other matters such as estate rights, protection from debts, and counsel fees.  For example, it may set forth whether maintenance will be paid, in what amount and for how long.  The Agreement will ordinarily identify the parties' pre-marital assets to insulate them from future, potential division.  Similarly, it may set forth the future allocation of assets and debts acquired during the marriage.  A prenuptial agreement may not, however, violate public policy.   The attorneys at Falco & Morton Law, PLLC have extensive experience in drafting and negotiating prenuptial agreements and antenuptial agreements.
